Insignia Education Blue, committed to the world's virtual community and to expanding knowledge, ensures accessibility to the educational platform from anywhere in the world. This document therefore contains the general policies, terms and conditions that are expressly accepted every time the knowledge management service is used through Courses, Workshops, Diplomas, and Advanced Studies Certification (aimed exclusively at university professionals).
We reserve the right to approve or reject the provision of services or content in cases we deem appropriate, as well as the right to make changes to our portal without prior notice, due to the update, correction, modification, or removal of content, as the portal will be evaluated and optimized periodically. Third parties are expressly prohibited from framing or using mechanisms that alter the design, configuration, or content of the portal.
These policies, terms and conditions may change at any time as the dynamics of updates warrant, or when new best practices become necessary.
Trust and safety
Our teachers of Courses, Workshops, Diplomas, and Advanced Studies Certification (aimed exclusively at university professionals) have a duty to review these policies periodically to ensure compliance with any updates made to them. Use of the Services is subject to the approval of Insignia Education Blue (IEB), which may grant or deny it at its sole discretion.
IEB reserves the right to remove, suspend, ban, or block teachers, students, partners, or organizations for inappropriate events, at any time and without prior notice, including in the following cases:
- Failure to comply with our policies or legal conditions (including the Terms of Use).
- A course falls below our quality standards or negatively impacts the student experience.
- Behavior that could unfavorably affect Insignia Education Blue, leading to discredit, disparagement, scandal, or public disrepute.
- Hiring or subcontracting the services of a merchant or other business partner who violates Insignia Education Blue's policies, or is determined to do so at its sole discretion.
Teachers and collaborating instructors
The Insignia Education Blue platform allows our teachers to add collaborating instructors to the courses, workshops, diplomas, or advanced studies certifications they manage. By adding a collaborating instructor, the teacher authorizes them to take certain actions affecting their teacher account and courses. IEB cannot advise on or mediate any conflict between a teacher and their collaborating instructors. If collaborating instructors have an assigned revenue share, that is not IEB's responsibility; our responsibility is to pay 60% of the revenue share obtained from managing the course, based on the agreed terms.
Teacher's relationship with other users
Teachers do not have a direct contractual relationship with students, so the only information they will receive about students is that provided through the established services. The teacher agrees not to use data received for purposes other than providing academic services to those students on the IEB platform, and not to request additional personal data or store students' personal data outside the IEB platform. Otherwise, the teacher will indemnify IEB against any claim arising from misuse of students' personal data.
Teachers access their list of students using their teacher user code, and are required to mark attendance for their students on the platform, as well as their own, according to the academic coordination department's guidelines.
Teacher commitments
As a teacher of a course, workshop, diploma, or advanced studies certification (aimed exclusively at university professionals), you are responsible for all content you publish, including lectures, quizzes, coding exercises, tests, assignments, resources, forum responses, the course homepage content, and announcements.
You represent and warrant that:
- You will provide and maintain accurate information about your account.
- You have the necessary authority to authorize IEB to use your submitted content as specified in these conditions and the terms of use; your submitted content does not infringe or misappropriate any third party's intellectual property rights; you have the required qualifications, credentials, and experience (including education, training, knowledge, and skills) to teach and provide the services offered through your submitted content and your use of the Services; and you will respond promptly to students and ensure a quality of service consistent with industry standards and general instructional services.
You likewise represent that:
- You will not publish or provide any inappropriate, offensive, racist, hateful, sexist, pornographic, false, misleading, incorrect, illegitimate, defamatory, or slanderous content or information.
- You will not publish or transmit unsolicited or unauthorized advertising, promotional materials, spam, or any other form of solicitation (commercial or otherwise) through the Services or to any user.
- You will not use the Services for anything other than providing tutoring, teaching, and instructional services to students.
- You will not engage in any activity that would require us to obtain licenses or pay royalties to third parties, including the need to pay royalties for the public performance of a musical work or sound recording.
- You will not frame or embed the Services (such as embedding a free version of a course) or otherwise circumvent them or discounts without consultation or approval from IEB.
- You will not impersonate another person, gain unauthorized access to another person's account, interfere with or otherwise prevent other teachers from providing their services or courses, or abuse IEB's resources.
Copyright
The design of the Portal, as well as its source code, logos, trademarks, and other characteristic signs appearing on the Web Platform, belong to Insignia Education Blue. The content of Courses, Workshops, Diplomas, and Advanced Studies Certifications (aimed exclusively at university professionals) belongs to the authors of said products, and IEB respects their intellectual property.
Use, reproduction, distribution, public communication, transformation, or any similar or analogous action is totally prohibited while the contract between the parties remains in force, to avoid harm under the Privacy Policy. In this regard, IEB commits to not providing your information to advertisers, except anonymous statistical data on portal usage, for the purpose of improving the service and offering products that meet user expectations.
In any case, Insignia Education Blue declares its respect for the intellectual and industrial property rights of course creators.
Protection
We partner with anti-piracy providers to help protect your courses from unauthorized use. To enable this protection, you hereby designate Insignia Education and our anti-piracy providers as your agents for the purpose of exercising the copyright of each of your courses, through notice and takedown processes (in accordance with applicable copyright legislation, such as the Digital Millennium Copyright Act), as well as other enforcement efforts. You grant Insignia Education and our anti-piracy providers primary authority to send notices on your behalf to defend your copyright-related interests.
Dispute resolution
Should a complaint arise, our support team will be glad to help resolve the issue directly, consensually, and cordially. In such a case, the dissatisfied party must file a written claim, expressly noting that it marks the start of this stage. If the dispute continues, an alternative dispute resolution mechanism should be pursued and, finally, if that is not effective either, the matter may be brought before the relevant jurisdiction.
Applicable law
Legal processes or services are governed by Venezuelan law, in matters not expressly established in these policies, terms, and conditions. Any dispute or conflict arising between the client and Insignia Education Blue will be resolved according to the laws of the Bolivarian Republic of Venezuela, within Insignia Education Blue's jurisdiction (Valencia, Venezuela), without effect from conflict with the laws of other countries or the user's current country of residence.
Notifications
All communications between the parties will take place through electronic means. The email provided by Insignia Education Blue is info@insigniaeducation.com. The email provided by the partner, client, or user will be the one supplied in the platform's enrollment or registration form. Any notification may also be made via the registered cell phone number. Any notification will be deemed made on the day the email is sent.
Responsibilities of students, partners, clients, or users
- They agree not to destroy, alter, misuse, disable, or damage the data, information, programs, or electronic documents of Insignia Education Blue nor of other students, partners, clients, or users.
- They agree not to use a false identity, impersonate another person to use the platform, participate in courses or other products or services, nor disclose passwords or access credentials to third parties, nor in any other way harm the normal operation of this academic platform.
- They have access to all course content and study materials on the platform and app. However, users must respect the copyright of course content and materials. Copying, reproduction, archiving, distribution, modification, display, performance, publication, licensing, creation of derivative works, resale, and/or any other use outside what is specified in these conditions is NOT permitted.
- Course information and content available on the Insignia Education Blue platform may be changed or removed without prior notice.
- Certificates are issued in digital format.
- Payment methods and forms are those available through the payment gateway.
- The price of products is stipulated in each course's details.
- Regarding possible technical deficiencies, Insignia Education Blue is not responsible in any case for service disruptions caused by failures in the power supply network, data connection network, server, or any other services.
Refunds
Students have the right to receive a refund within 7 calendar days from the start of the course. Teachers will not receive any income from transactions for which a refund has been granted, due to administrative processing costs.
Refunds have a 15% cost, which is retained by the company for administrative expenses and payment processor fees. If a student requests a refund after we have already paid the corresponding instructor payment, IEB reserves the right to deduct the refund amount from the next payment sent to the instructor.
Additionally, there is an administrative-expense discount percentage, determined case by case, based on the partner running the course, the fees involved depending on the payment method, the exchange rate at the time of payment, among other factors at the discretion of Insignia Education and its partners.
Blocking
Insignia Education reserves the right to block (with or without notice and/or the user's consent) platform users (temporarily or permanently), social media, chat applications, and any other means of interaction between the user and any community member, in any of the following cases:
- Disrespect toward any member of the Insignia Education community.
- Uncollaborative attitudes when facing conflicts.
- Misuse of the platform.
- Misuse of materials inside or outside the platform.
- Flagrant detection of any type of copyright violation.
- Conflicts involving improperly made payments or refunds requested without cause by the user.
- Court orders.
- Ordinances under local or international law.
- Detection of money laundering.
- Judicial or extrajudicial disqualifications.
Grounds for blocking are not limited to this list and are at the discretion of Insignia Education Blue's staff. This applies not only to judicial or extrajudicial requests from the jurisdiction clarified above, but from any country where Insignia Education has any type of activity.
Payments
Payments must always be made in cash, on the appropriate date, and reported at the time of payment. For payments in currencies other than the dollar, the applicable exchange rate will be the one indicated by the platform (without exceptions) at the time of payment.
If a payment was made without being reported on the platform, from the seventh calendar day onward, in the event of an increase in the payment currency's exchange rate or a change in the course price, the student must complete the payment at the price in effect at the time they report the issue to the Insignia Education team.
Live sessions
We call "live session" any interaction carried out through a video conferencing service (for example, but not limited to, Zoom, Google Meet, Microsoft Teams, or any similar communications software/service). The company, teachers, and partners have the authority and right to record all meetings in which the company is involved.
For quality reasons, teachers are required to record all live sessions in which they are present; failure to do so will result in a penalty.
Students may request access to a recording of a session they attended by writing to academy@insigniaeducation.com or through the communication channels available on the platform. These recordings are kept for a limited time, never less than one month; this period may change depending on operational and regulatory decisions.
